General conditions of sale for stays in guest rooms

 “Villa Milano”

These general conditions of sale are intended for the use of the reservation of stays in bed and breakfast at  "Villa Milanu", 20232 Oletta, France. 

They constitute the reservation contract between the owner, Nathalie Thoni and the client of a stay in a bed and breakfast.

 

Article 1 – Duration of stay: the customer rents one or more rooms for a fixed period and may not under any circumstances claim any right to remain in the premises.

 

Article 2 – Prices: the prices indicated on the websites www.villamilanu.fr and  www.booking.fr are the only contractual prices. They include all taxes (the owner is not subject to VAT, article 293 B of the CGI).

 

Article 3 – Validation of a reservation: the reservation is made by email or by telephone directly with the owner, or through one of the following reservation sites:www.booking.comor www.airbnb.fr.

The reservation is considered firm only after receipt of deposit cashed upon receipt and deductible from the invoice upon your arrival. The deposit must be paid no later than 5 working days from the date of the reservation request.

The amount of the deposit is:

• In the case of a direct reservation with the owners: 30% of the total price of the stay with a

minimum corresponding to the price of one night per reserved room.

• In the case of a reservation via the site www.booking.com: 30% of the total price of the stay 

• In the case of a reservation via the site www.airbnb.fr: see with the site of

reservation concerned.

The payment of the deposit can be made:

• by bank check (payable to Nathalie Thoni)

. by bank transfer (RIB address by email automatically

The payment of a deposit implies acceptance of these general conditions of sale.

If the reservation is made by telephone, we undertake to confirm receipt of the deposit by telephone, sms or email.

 

Article 4 – Cancellation by the customer: any cancellation must be notified by registered letter or email addressed to the owner.

The cancellation of a reservation will only become effective after confirmation by email that it has been taken into account by Villa Milanu

10 days before the date of arrival the customer may request a postponement of his reservation free of charge in the event of reconfinement due to COVID-19

• If the cancellation occurs more than 21 days before the start of the stay, the deposit will be returned to the customer.

• If the cancellation occurs less than  21 days before the start of the stay, the deposit remains with the owner who reserves the right to claim the balance of the price of the accommodation.

• If the client does not show up before 7 pm on the day scheduled for the start of the stay, the owner reserves the right to dispose of her guest rooms. The deposit remains with the owners who reserve the right to claim the balance of the price of accommodation.

• If the customer does not respect the maximum arrival time, the owner reserves the right to refuse to welcome customers. The deposit remains with the owner who reserves the right to claim the balance of the price of accommodation.

  • In the event of a shortened stay, the price corresponding to the cost of accommodation remains fully acquired by the owner. Only the additional services consumed will be due to the owner.

 

Article 5 – Cancellation by the owner: when, before the start of the stay, the owner cancels the stay, for reasons beyond her control, she must inform the client as soon as possible by telephone or email. This will be refunded immediately of the sums paid.

 

Article 6 – Time of arrival: the customer must arrive on the specified day of the reservation and at the times mentioned below. Rooms are available from17 hours.Please let us know in case of arrival after 7 p.m. We do not accept arrivals after 7:00 p.m. between October 1 and April 30, after 8:30 p.m. between July 15 and September 30 and we reserve the right to no longer welcome the client after these times. This refusal can in no way be considered as a modification or breach of the contract at the initiative of the owner, so that no refund can be considered.

Article 7 – Departure time: the rooms must be vacated by 11 am. After 12 noon you will be charged an additional night.

Article 8 – Payment of the balance of the accommodation: the balance of the stay will be paid on arrival. The payment of the balance can be made:

• Cash

Consumption and additional services not provided for will be paid at the end of the stay.

Article 9 – Tourist tax: the tourist tax is a local tax and is added to the price of the night. It is collected by the owner on behalf of the municipality and is then transferred to the Public Treasury.

 

Article 10 – Change of rooms: without the customer being able to claim any compensation, the owner reserves the right to change the room initially reserved by the customer with a room of the same capacity or of greater capacity. In such a case, the cost of the reservation remains unchanged.

 

Article 11 - Capacity: the reservation is made for a specific number of people. If the day of arrival, the number of occupants is higher, the owner is able to refuse the additional people. This refusal can in no way be considered as a modification or a breach of the contract at the initiative of the owner, so that in the event of the departure of a number of people greater than those refused, no refund can be considered. .

 

Article 12 - Children: Children from 6 years old are welcome at Villa Milanu:

  • For children under 6, call or send an email.

• Children over 6 years old are charged the same as adults. For children under 6 years old, 30 € per night will be required.

Article 13 – Breakfast: Breakfast is served as and when arrivals from 8:00 to 10:00 outside, weather permitting. Otherwise, around the family table.

Article 14 - Pets: Pets are not  accepted. If the day of arrival, the client arrives accompanied by one or more unannounced animals, the refusal to accept the animals and their owners by the owners of the guest rooms cannot be considered as a modification or a rupture of the contract at the initiative of the owners. So that in case of departure of the customer, no refund can be considered.

 

Article 15- Art of living, use of the premises: Respect for a certain art of living is required of all guests to guarantee the tranquility of the place and the comfort of its guests. In addition, "Villa Milanu" is a completely non-smoking area, with the exception of the outdoor terrace. It is also requested not to eat in the rooms.

The customer undertakes to respect the instructions for etiquette appearing in the rooms and in these general conditions of sale. The customer undertakes to return the rooms in perfect condition at the end of the stay and to declare, and assume financially, any possible deterioration for which he may be responsible.

Children evolving within “Villa Milanu” are under the sole responsibility of their parents. The one hectare park as well as the swimming pool area could present a danger for children left unsupervised.

           

Article 16 – Computing and freedoms: In accordance with the law of January 6, 1978, you have the right to access and rectify data concerning you. “Villa Milanu” undertakes not to transmit the information that you have communicated to it to other companies or organisations.

These conditions of sale are subject to change at any time without notice. Acceptance and compliance with these general conditions of sale are deemed acquired upon payment of the deposit.
